Terms and Conditions
Last updated: 10 October 2026
These terms tell you who we are, how we will supply goods to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. Please read them before you place an order. By placing an order you agree to them.
1. Who we are
Legal name: DENMARIE LIMITED
Trading name: DENMARY
Company number: 09460631, registered in England and Wales
Registered office: 21 West View, Wesham, Preston, England, PR4 3DA
Email: info@denmary.co.uk
"We", "us" and "our" mean DENMARIE LIMITED. "You" means the person placing the order. Our full trader details are in our Legal Notice.
2. These terms and other documents
These terms apply to every order placed through denmary.co.uk. Read them alongside the other documents that form part of your contract with us: our Cancellations, Returns and Refunds Policy, our Delivery information, our Privacy Policy and our Cookie Policy. If anything in these terms conflicts with one of those documents, these terms take priority, unless the other document gives you more.
Our shop runs on Shopify, which provides the e-commerce platform. Orders placed through Etsy, eBay or any other marketplace are governed by that marketplace's terms in addition to ours, and cancellations or claims for those orders should go through that marketplace first.
We may update these terms. The version that applies to your order is the version published when you placed it.
3. How the contract is formed
Your order is an offer to buy from us. Placing an order does not create a contract by itself.
After you order, we email you an order confirmation. The contract between you and us comes into existence when we send that email. If we cannot accept your order - because an item is unavailable, because we cannot produce the personalisation you asked for, because we spotted a pricing error, or because we cannot verify your payment - we will tell you and refund any money you have paid.
Each order is a separate contract. We may refuse an order, and we may limit quantities per customer, per household or per payment method.
4. Personalised items
Most of our range is personalised: names, numbers, dates, text and artwork are produced exactly as you enter them at checkout, so please check your spelling and details carefully before you order. Choosing a size or a colour from the options on a product page does not by itself make an item personalised. Our Cancellations, Returns and Refunds Policy explains what counts as personalised.
We print what you submit. We do not correct spelling or capitalisation on your behalf. If you have made a mistake in your personalisation, contact us at info@denmary.co.uk straight away and we will change it if production has not started - but once an item has gone into production we cannot amend it, and you will need to place a new order.
When you supply a name, a number, a logo, a photograph or any other artwork, you confirm that you own it or have permission to use it, and that it does not infringe anyone else's rights. We may refuse any personalisation request that appears to infringe a third party's trade mark or copyright, or that is offensive, and we will refund you in full if we do.
5. Prices and payment
The price is the price shown on the product page when you place your order, plus any delivery charge shown at checkout. All prices are in pounds sterling.
DENMARIE LIMITED is not registered for VAT. No VAT is charged on your order and we cannot issue a VAT invoice.
Payment is taken at checkout. Prices can change, but a change will never affect an order we have already accepted.
Products do occasionally get mispriced. If the correct price is lower than the price you were shown, we charge the lower amount. If the correct price is higher and the error is obvious enough that you could reasonably have spotted it, we will contact you before dispatch and you can confirm the order at the correct price or cancel it for a full refund.
6. Delivery
Dispatch times, delivery estimates, carriers and postage costs are set out on our Delivery page. Delivery estimates are estimates and not guarantees.
Goods stay at our risk until they come into your physical possession, or that of a person you named to receive them (section 29 of the Consumer Rights Act 2015). If you ask for a parcel to be left in a safe place or with a neighbour, delivery there counts as delivery to you. You own the goods once we have received payment in full.
Please make sure the delivery address is correct. If a parcel is returned to us because the address was wrong or incomplete, or because it was not collected or was refused, our Cancellations, Returns and Refunds Policy explains what happens next.
If nobody is available at your address and the goods cannot be posted through your letterbox, the carrier will leave a note explaining how to rearrange delivery or collect the parcel. If you do not rearrange delivery or collect the goods and they come back to us, we will contact you for instructions.
7. Your right to cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days from the day you receive an online order to cancel it without giving a reason.
That right does not apply to goods made to your specification or clearly personalised. Regulation 28(1)(b) creates this exception, and most of our range falls inside it - iron-on transfers carrying your name, number, text or logo, T-shirts and hoodies with your words, and any item customised to your order. Our Cancellations, Returns and Refunds Policy explains what counts as personalised. A personalised item cannot be cancelled under the 14-day right, but you can cancel it before production, as set out below.
For non-personalised items, the 14-day right applies in the ordinary way. Tell us within 14 days of delivery, return the goods within 14 days of telling us, and we will refund the price plus our standard delivery charge within 14 days of receiving them back, or of you giving us proof of postage if that is sooner. You pay the cost of returning them. You may handle the goods as you would in a shop; if you handle them beyond that and reduce their value, we may reduce your refund to reflect it.
You can cancel any order at any point before it goes into production. Email info@denmary.co.uk with your order number. Many of our orders - particularly personalised ones - enter production within minutes, so please contact us immediately if you change your mind.
This section does not affect your rights if something is wrong with the goods. Those rights are in section 8 and they apply to personalised items too.
8. If something is wrong with your order
Nothing in these terms limits your statutory rights. Under the Consumer Rights Act 2015 the goods we supply must be of satisfactory quality, fit for purpose, and as described. Personalised goods are covered in full - being made to your specification does not remove any of these rights.
If we have made the mistake - wrong item, wrong personalisation, faulty transfer, damage in transit - email info@denmary.co.uk with your order number and a photograph of the problem. We will replace the item or refund you, at our cost. You do not have to pay return postage on an item that is faulty or that we got wrong.
Your statutory rights, in outline:
- Within 30 days of delivery: you can reject faulty goods and get a full refund.
- Up to 6 months: you can ask for a repair or replacement. If that fails, you can claim a refund or a price reduction. During this period, the law assumes any fault was there at delivery unless we can show otherwise.
- Up to 6 years in England and Wales, or 5 years in Scotland: you can still claim if you can show the fault was present when the goods were delivered.
We refund to your original payment method. Once we have approved a refund we process it within 14 days, though your bank may take a few days more to show it.
9. Applying our transfers
Our transfers are supplied for you to apply to fabric using a household iron or a heat press, following the instructions supplied with your order.
Results depend on the garment, the fabric blend, the equipment and the method used. Those are outside our control. We are not responsible for damage to your own garments caused by applying a transfer at the wrong temperature, for the wrong duration, or to an unsuitable fabric. If you are unsure whether a transfer suits your fabric, ask us before you apply it, and test on a spare piece where you can.
This does not affect your rights under section 8 if the transfer itself is faulty.
10. Intellectual property
All designs, templates, layouts, photographs and text on this website belong to DENMARIE LIMITED or our licensors. You may not copy, reproduce or resell them without our written permission.
Buying a personalised item gives you the item. It does not transfer ownership of the underlying design, and it does not give you the right to reproduce that design commercially.
You keep ownership of any artwork you send us. By sending it, you give us permission to use it for the purpose of producing and delivering your order. If you believe something on this site infringes your rights, our Intellectual Property Notice explains how to tell us.
11. Our responsibility to you
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. Loss or damage is foreseeable either if it is obvious that it will happen, or if both of us knew it might happen when the contract was made.
We do not exclude or limit our liability in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the goods under the Consumer Rights Act 2015, and for defective products under the Consumer Protection Act 1987.
We are not liable for business losses. We supply our goods for domestic and private use. If you use them for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
12. Business customers
If you are buying as a business - bulk transfers, team kit, workwear or logo orders - sections 7 and 8 do not apply, because the Consumer Contracts Regulations and the Consumer Rights Act protect consumers rather than businesses. Business orders are supplied on the basis that you have checked the specification and artwork before ordering. Please contact us at info@denmary.co.uk before placing a large or repeat order so we can agree terms in writing.
13. Events outside our control
We are not liable for delay or failure to perform caused by something outside our reasonable control - carrier failures, extreme weather, power or network outages, supply shortages, or industrial action. If such an event happens, we will contact you as soon as we can. Where the delay is substantial you may contact us to cancel and receive a refund for anything you have paid for but not received.
14. Complaints
Contact us first at info@denmary.co.uk. We aim to reply within one working day and we will always try to put things right.
We do not belong to an alternative dispute resolution scheme and are not required to. If you are not happy with how we have handled a complaint, you can get free independent advice from Citizens Advice on 0808 223 1133 or at citizensadvice.org.uk, and you retain the right to take a claim to court.
15. Other important terms
We may transfer our rights and obligations under these terms to another organisation. We will tell you in writing if that happens and it will not affect your rights. You may only transfer your rights or obligations to someone else if we agree in writing.
This contract is between you and us. Nobody else has any right to enforce any of its terms.
Each paragraph of these terms operates separately. If a court decides that any of them is unlawful, the rest will remain in force.
If we delay in enforcing this contract, or do not insist that you do something you are required to do, that does not mean we have given up our right to do so later.
16. Governing law and jurisdiction
These terms are governed by the law of England and Wales, and any dispute may be brought in the courts of England and Wales.
If you live in Scotland you may also bring proceedings in the Scottish courts, and if you live in Northern Ireland you may also bring proceedings in the Northern Irish courts. Nothing in this section removes any protection you have under the mandatory consumer law of the part of the United Kingdom where you live.
